Terms and Conditions

1. INTRODUCTION

Welcome to Seva Company's mobile application (the "Application" or "App"). These Terms and Conditions ("Terms") constitute a legally binding agreement between you and Seva Company ("we," "us," or "our") governing your use of our Application, available on iOS and Android platforms.

By downloading, accessing, or using our Application, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, please do not download, access, or use the Application.

2. DEFINITIONS

  • "Application" or "App" refers to the Seva Company mobile application.
  • "Customer" refers to individuals who use the Application to book services.
  • "Service Partner" refers to individuals who provide services through the Application, including but not limited to house help, hotel staff, chefs, construction workers, and other labor partners.
  • "Services" refers to the services offered by Service Partners through the Application.
  • "User" refers to any person who accesses or uses the Application, including both Customers and Service Partners.

3. ELIGIBILITY

To use our Application, you must be at least 18 years of age and capable of forming a binding contract. By using the Application, you represent and warrant that you meet these eligibility requirements.

For Service Partners, additional eligibility requirements may apply, including but not limited to:

  • Valid identification documents
  • Successful completion of verification processes
  • Compliance with local labor laws and regulations

4. ACCOUNT REGISTRATION

4.1 Customer Registration

To use our Application as a Customer, you must create an account by providing accurate and complete information, including your name, email address, and phone number.

4.2 Service Partner Registration

To register as a Service Partner, you must:

  • Provide accurate and complete personal information
  • Submit valid KYC documents (PAN card, Aadhaar card, address proof, etc.)
  • Complete any required verification processes
  • Provide information about your services, qualifications, and availability

4.3 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to:

  • Create a strong password
  • Keep your account credentials confidential
  • Notify us immediately of any unauthorized use of your account
  • Ensure that you log out of your account at the end of each session

We reserve the right to suspend or terminate accounts that violate these Terms or engage in suspicious activities.

5. SERVICE BOOKING AND PROVISION

5.1 For Customers

  • The Application allows Customers to browse, search for, and book Services provided by Service Partners.
  • Customers may book Services based on location, availability, and service type.
  • Customers agree to provide accurate information when booking Services, including location, service requirements, and scheduling details.
  • Customers may cancel bookings in accordance with our cancellation policy outlined in Section 6.

5.2 For Service Partners

  • Service Partners agree to provide Services professionally, competently, and in accordance with industry standards.
  • Service Partners must accurately represent their qualifications, experience, and capabilities.
  • Service Partners must arrive on time for scheduled Services.
  • Service Partners must maintain appropriate licenses, permits, and insurance required for their Services.
  • Service Partners must comply with all applicable laws and regulations.

5.3 Service Quality

While we strive to ensure high-quality services through our vetting processes, we do not guarantee the quality, safety, or legality of Services provided by Service Partners. We are not responsible for the acts or omissions of Service Partners.

6. CANCELLATION AND REFUND POLICY

6.1 Customer Cancellations

Customers may cancel bookings through the Application.

Cancellation fees may apply depending on the timing of the cancellation:

  • Cancellations made more than 24 hours before the scheduled service: No fee
  • Cancellations made between 12-24 hours before the scheduled service: 25% fee
  • Cancellations made between 4-12 hours before the scheduled service: 50% fee
  • Cancellations made less than 4 hours before the scheduled service: 75% fee
  • No-shows: 100% fee

6.2 Service Partner Cancellations

  • Service Partners may cancel accepted bookings only in exceptional circumstances.
  • Repeated cancellations by Service Partners may result in penalties, including temporary or permanent suspension from the Application.
  • If a Service Partner cancels, the Customer will receive a full refund.

6.3 Refunds

  • Refunds will be processed according to the cancellation policy above.
  • Customers may be eligible for partial or full refunds if Services were not provided as described or were of unacceptable quality.
  • Refund requests must be submitted within 48 hours of the scheduled Service completion.

7. PAYMENTS

7.1 Service Fees

  • All fees for Services are set forth in the Application at the time of booking.
  • Fees may vary based on service type, duration, location, and other factors.
  • All fees are inclusive of applicable taxes.

7.2 Payment Processing

  • Payments are processed securely through our third-party payment processors.
  • By making a payment through the Application, you authorize us to charge the designated amount to your selected payment method.

7.3 Service Partner Earnings

  • Service Partners will receive payment for their Services as described in their Service Partner Agreement.
  • We may deduct a platform fee from payments to Service Partners.
  • Payments to Service Partners will be processed within 7 business days of Service completion.

8. USER CONDUCT

All Users agree not to:

  • Use the Application for any illegal purpose
  • Harass, abuse, or harm another person
  • Impersonate another person or entity
  • Provide false or misleading information
  • Attempt to gain unauthorized access to other user accounts or our systems
  • Interfere with the proper operation of the Application
  • Use the Application to send unsolicited communications
  • Use the Application in any manner that could disable, overburden, or impair it
  • Use any robot, spider, or other automated device to access the Application
  • Engage in any conduct that restricts or inhibits anyone's use or enjoyment of the Application

9. REVIEWS AND RATINGS

9.1 Customer Reviews

  • Customers may leave reviews and ratings for Service Partners.
  • Reviews must be honest, fair, and based on actual experiences with the Service Partner.
  • We reserve the right to remove reviews that violate our guidelines or these Terms.

9.2 Service Partner Ratings

  • Service Partners may be rated based on their performance, reliability, and professionalism.
  • Service Partners with consistently low ratings may be subject to review and potential removal from the platform.

10. INTELLECTUAL PROPERTY

10.1 Our Intellectual Property

The Application, including all content, features, and functionality, is owned by Seva Company and is protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any materials from our Application without our prior written consent.

10.2 Limited License

We grant you a limited, non-exclusive, non-transferable, revocable license to use the Application for its intended purposes in accordance with these Terms.

11. LIMITATION OF LIABILITY

To the maximum extent permitted by law, in no event shall Seva Company, its affiliates, or their respective officers, directors, employees, or agents be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

  • Your access to or use of or inability to access or use the Application;
  • Any conduct or content of any third party on the Application;
  • Any content obtained from the Application; and
  • Unauthorized access, use, or alteration of your transmissions or content

Whether based on warranty, contract, tort (including negligence), or any other legal theory, whether or not we have been informed of the possibility of such damage.

12. DISCLAIMER OF WARRANTIES

The Application is provided "as is" and "as available" without warranties of any kind, either express or implied. To the fullest extent permissible pursuant to applicable law, we disclaim all warranties, express or implied, including, but not limited to, implied warranties of merchantability and fitness for a particular purpose.

We do not warrant that the Application will be uninterrupted or error-free, that defects will be corrected, or that the Application or the servers that make it available are free of viruses or other harmful components.

13. INDEMNIFICATION

You agree to defend, indemnify, and hold harmless Seva Company, its affiliates, and their respective officers, directors, employees, and agents from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Application.

14. TERMINATION

14.1 Termination by You

You may terminate your account at any time by contacting us at thesevacompany@gmail.com or through the account deletion option in the Application.

14.2 Termination by Us

We reserve the right to suspend or terminate your access to the Application at any time, without notice and for any reason, including but not limited to:

  • Violation of these Terms
  • Fraudulent or illegal activity
  • Abusive behavior toward other Users or our staff
  • Extended periods of inactivity (30 days or more)

14.3 Effect of Termination

Upon termination:

  • You will no longer have access to your account
  • Any pending bookings may be canceled
  • Your data will be handled in accordance with our Privacy Policy

15. GOVERNING LAW AND DISPUTE RESOLUTION

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions.

Any dispute arising out of or in connection with these Terms, including any question regarding its existence, validity, or termination, shall be referred to and finally resolved by arbitration in accordance with the Arbitration and Conciliation Act, 1996. The seat of arbitration shall be Mumbai, India. The language of the arbitration shall be English.

16. CHANGES TO TERMS

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Application after any revisions become effective, you agree to be bound by the revised Terms. If you do not agree to the new Terms, you are no longer authorized to use the Application.

18. SEVERABILITY

If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law and the remaining provisions will continue in full force and effect.

19. ENTIRE AGREEMENT

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Seva Company regarding the Application and supersede all prior and contemporaneous agreements, proposals, or representations, written or oral, concerning its subject matter.

By using our Application, you acknowledge that you have read these Terms, understand them, and agree to be bound by them.
